Board of Adjustment

The Board of Adjustment hears the following appeals:

  • Decisions of the Planning Commission regarding administrative decisions of Borough employees made in the enforcement, administration or application of a land regulation
  • Planning Commission decisions regarding conditional use requests
  • Planning Commission decisions on a request for a variance
  • Planning Commission decisions on a modification to a Planned Unit Development (PUD)

The Borough Mayor and Assembly serve as the Board of Adjustment. Appeals to the Board of Adjustment are processed in accordance with 18.90.070(b). Meetings of the Board are held at the call of the presiding officer and are open to the public. Click here for more information about the Board of Adjustment rules of procedure.

An appeal to the Board of Adjustment must be filed with the Borough Clerk, along with a $200 filing fee, within 15 days of the Planning Commission Decision from which an appeal is sought. A specific statement of the basis and grounds for the appeal, along with the relief sought, must be attached to the appeal form.
